Why Getty Images Is Suing an AI Art Generator

You may have seen all your Facebook or Instagram friends posting more artwork than they’ve been known to have the skills for. AI art is easy for people to obtain, but some generators use copyrighted work to create their art, and Getty Images is not taking it lying down.
Getty Images Is Suing an AI Art Generator
Getty Images—one of the world’s largest image libraries—is suing the AI art generator, Stability AI. In a statement from Getty Images’ Newsroom in January 2023, the image library giant has commenced legal proceedings in the High Court of London against Stability AI.
This is the first known case of a big art provider suing an AI generator—although there have been plenty of questions of morality regarding AI art generators and where they retrieve their information from.
Stability AI’s homepage states ‘We respect innovation over tradition’. Does that suggest the company may have questionable morals regarding art generation? There have been no other comments from Stability AI over this case so far.
Why Is Getty Images Suing Stability AI?
Getty Images claims that Stability AI has infringed on intellectual property rights including copyright and licensing of imagery owned and created directly by Getty Images.
Although part of the dark side of AI art, this isn’t simply a case of stolen artwork. Getty Images believes and supports the idea of training artificial intelligence to broaden creative endeavors. The image library business provides licenses to AI companies who wish to use Getty Images’ work in their creative AI projects. It openly supports the ways AI is changing the future of art.
Stability AI did not obtain any such license from Getty Images, however.
The AI art tool ignored the licensing options offered by Getty Images, putting its own AI creations and commercial interests above legal protections for all involved parties. Innovation over tradition, indeed.
Getty Images’ statement believes that other AI generators are following the rules and purchasing licenses as encouraged.
What Could This Mean for the Future of AI Art Generation?
This is a licensing issue, which is not quite the same as direct theft from creators. But the fact that Getty Images is taking Stability AI to court shows how serious any wrong footing in AI art generation can become.
This case doesn’t threaten a halt on AI generators using image libraries, but at best it may change the rules on how anyone—AI companies or humans alike—can access those images for commercial use.
With the knowledge that Getty Images supports the expansion and learning brought on by AI, this may be a one-and-done court case.
AI Art Generators Need to Follow the Rules
AI generation tools are changing the shape of art creation and ownership. Although this case is a license avoidance problem rather than the theft issues creative workers have anticipated in the wake of the AI movement, it could still be what draws the line in the sand.
And it seems that Getty Images’ overall stance on AI image generation is positive—as long as the rules are followed.
